Marc Trost Financial (“MTF”) is committed to protecting your personal information. Privacy and security are fundamental elements of our commitment to our clients. We do not disclose any nonpublic personal information about current or former clients to anyone, except as outlined below.
Our Commitment:
· We are committed to protecting your privacy at all times.
· We do not share your personal information with outside companies for purposes of selling their products and services to you.
We collect nonpublic personal information about you, including but not limited to:
· Information from forms that you may complete and send to MTF in connection with opening a separately managed account (such as name, address, and social security number).
· Information you may give MTF orally.
· Information about the amount you have invested with MTF.
· Information about any bank or other financial account you may use for transfers between such account and a client account managed by MTF.
Except for disclosure that may be required by applicable law, MTF shall maintain the strictest confidence regarding the affairs of our clients. Situations that may arise requiring us to share information include:
· When protecting against or preventing fraud.
· In resolving customer disputes.
· In dealings with attorneys, compliance consultants or auditors.
· When requested by a consumer reporting agency in accordance with other applicable law.
· When complying with a validly issued and enforceable subpoena or summons.
· In the course of a review of our firm’s practices under the authorization of a state or national licensing board, or as necessary to properly respond to an inquiry or complaint from such a licensing board of organization.
· In conjunction with a prospective purchase, sale, or merger of all or part of our practice, provided that we take appropriate precautions (for example, through a written confidentiality agreement) so the prospective purchaser or merger partner does not disclose information obtained in the course of the review.
· As a part of any actual or threatened legal proceedings or alternative dispute resolution proceedings either initiated by or against us, provided we disclose only the information necessary to file, pursue, or defend against the lawsuit and take reasonable precautions to ensure that the information disclosed does not become a matter of public record.
We may share information about you with our affiliates as permitted by law, such as information about your transactions or experiences with us, our affiliates, or others. MTF will only share non-public customer information with outside entities in order to help administrate your business and/or provide you with specialized services. We may disclose information to the following types of outside companies:
· Financial institutions that would serve as the custodian of your assets.
· Non-financial companies that prepare proxy mailings or account statements.
· Independent contractors who program our software to help provide you protection and additional services.
· Service providers we hire to help administrate our business.
· Service providers to whom you direct us to share information, such as your CPA or legal counsel Companies we hire for services of this kind are not allowed to use your personal information for their own purposes and are contractually obligated to maintain strict confidentiality. We limit their use of your personal information to the performance of the specific service we have requested.
Except as otherwise described in this notice, we restrict access to nonpublic personal information about you to agents and employees at our firm and other parties who must use that information to provide services to you. Their right to further disclose and use the information is limited by the policies of our firm, applicable law, industry regulations, and nondisclosure agreements where appropriate. We also maintain physical, electronic, and procedural safeguards in compliance with applicable laws and regulations to guard your personal information from unauthorized access, alteration, or premature destruction.
